Placing a rubble container on the street in Palma requires a permit for occupying public space for construction work. This permit is requested from the Accessibility and Public Space Occupancy Service by sending the signed documentation in PDF format to tramitacioLOVP@palma.es. The processing time is immediate with a minimum of 72 hours' notice. A standard container occupies 6 m², a small one 4 m², and a construction bag 1 m². Two fees are payable: one for issuing the documents and another for occupying public space.

When do you need a permit to place a construction container in Palma?

As long as the container, rubble bag, scaffolding, fence, or props are placed on public land: roadway, sidewalk, or plaza. If all the material and rubble remain within the private property or the building's garage, an occupancy permit is not required.

It's a very common misconception: many people believe that the building permit already covers the container. It doesn't. They are two separate procedures with two separate files. The building permit—or the prior notification, if it's minor work—authorizes work on the property. The permit for occupying public space authorizes the use of the street. It is regulated by the municipal ordinance regulating the fee for the occupation of local public land with rubble, construction materials, fences, props, trestles and scaffolding, which the City Council publishes in its electronic headquarters. In a minor bathroom or kitchen renovation in a downtown apartment, this procedure is almost always necessary, because there is nowhere to put the rubble inside.

What documents are required and where can they be submitted?

The application is submitted signed in PDF format via email to tramitacioLOVP@palma.es, or in person at the citizen service offices. This is the documentation required by the Palma City Council:

  1. Specific application form, signed.
  2. Site plans and detailed occupation plans, to scale.
  3. Building permit or prior notification of the work it serves.
  4. Current photographs of the site are mandatory for renewals.
  5. Depending on the case: bank guarantee, photographic report and vehicle technical data sheet.

Point 2 is the one most often mishandled. Simply stating "in front of number 14" is insufficient: the container's placement must be clearly marked with measurements, and proof of sufficient pedestrian access must be provided. In narrow streets of the old town, this is precisely what determines whether the permit is granted or not.

How long does it take to get a container permit in Palma?

The processing time is immediate, with a minimum of 72 hours. This means you must apply at least three days before you need the container on the street, and if the documentation is complete, it will be processed quickly. If any document is missing, the application will be rejected and you will have to start the process again.

Those 72 hours are the reason this procedure is planned at the same time as the construction work, and not the day before the demolition begins. In our projects, we request it along with the initial notification, because a three-day delay at the start affects the rest of the schedule: without a place to dispose of the rubble, the demolition cannot proceed.

The amount is set in the current year's municipal tax ordinance and is calculated using two components: the document issuance fee (item 310-00) and the public thoroughfare occupancy fee (item 316-01), which is included with the permit itself. Since it depends on the current tax ordinance and the number of days of occupancy, the exact amount is confirmed at the time of application; however, it is always charged per square metre occupied and per period of time, so a large container left unused for two weeks costs considerably more than a small one managed with prompt removals.

Hence a practical decision that saves money: in bathroom or kitchen renovations in apartments in the centre, a small container with two or three removals is better than a large one occupying 6 m² during the entire work.

What happens if a container is placed without permission in Palma?

Without an occupancy permit, the City Council can order the immediate removal of the container and initiate the corresponding penalty proceedings according to the ordinance. And there is a less obvious consequence: if the unauthorized container causes an accident or damage, the responsibility falls on whoever placed it there, without any administrative protection.

It's a disproportionate risk for the cost of the procedure. In Palma, we often encounter individuals who have rented a container from a debris removal company and assume that the container company has the permit. This is almost never the case: the company supplies the container, not the license.

Who processes the permit: the owner or the renovation company?

Anyone can apply —the City Council indicates that the applicant is "indifferent"— but in practice it is logical that the company that carries out the work should process it, because it is the one that knows what days it needs the street and with what occupancy.

The reason is purely practical: whoever controls the works schedule is the one who should control the public highway schedule. Is it possible to avoid the bin in Palma's old town?

In very narrow streets in the city centre, where a container won't fit or pedestrian access can't be guaranteed, there are three real alternatives that we frequently use:

  • Construction bags of 1 m², which take up much less space and still require a license, but are authorized in locations where a container cannot fit.
  • Direct removal to landfill by van, Loading at agreed times without leaving anything parked on the street. It increases labour costs but eliminates the need for parking.
  • Storage inside the house or garage In bags, with programmed lowering. Only viable if there is space and an elevator, and if the weight is compatible with the floor slab.

The third option has a limit worth remembering: rubble weighs far more than it looks. Piling up bags of chipped-out rubble in a single room of an old flat is not always a good idea, and in homes with timber floor structures we simply do not do it. It's advisable to confirm this in writing before the truck arrives.
